Online Waiver & Entry Declaration
Organising Authority: Cruising Yacht Club of Hamilton Island Inc.
Event: Hamilton Island Regatta (15 & 16 May 2027)
1. Rules and Binding Agreement
By checking the box below, I agree to be bound by The Racing Rules of Sailing (RRS), the Prescriptions and Special Regulations of Australian Sailing (AS), the Notice of Race (NoR), and the Sailing Instructions (SI) for this event.
- I explicitly acknowledge RRS Rule 3 (Acceptance of the Rules) and RRS Rule 3.1(b), which states: "The responsibility for a boat’s decision to participate in a race or to continue racing is hers alone."
2. Risk Warning and Release of Liability
I acknowledge that competitive sailing is an inherently dangerous activity exposed to risks of personal injury, death, and property damage.
- To the maximum extent permitted by law, I release and indemnify the Cruising Yacht Club of Hamilton Island Inc., its officers, employees, volunteers, race committees, and event sponsors from any liability for personal injury, property damage, or death arising from participation in this event.
- I confirm that this disclaimer satisfies RRS Rule 82 and does not limit any consumer guarantees provided under Australian Consumer Law that cannot be legally excluded.
3. Insurance Warranty
I certify that the entered vessel holds a valid third-party liability insurance policy with a minimum coverage of AUD $10,000,000 per incident (or equivalent) covering competitive racing. I agree to upload or provide a valid Certificate of Currency to the Race Committee prior to racing.
4. Skipper’s Crew Declaration
As the person submitting this entry, I warrant that:
- Every crew member on board will be registered via the online crew list before the warning signal of the first race.
- All crew members comply with AS Prescription to RRS Rule 46 (holding active membership in an AS-affiliated club or a valid Sail Pass for the event dates).
- If any crew member is under the age of 18, I have obtained the express consent of their parent or legal guardian to participate under these terms.
5. Media and Privacy Consent
I grant the Organising Authority the perpetual, royalty-free right to use the boat’s name, crew names, and any photographic or video likeness of the vessel and crew collected during the event for promotional or media purposes. Personal data will be handled securely in line with the Australian Sailing Privacy Policy.
